    Failure to Diagnose

    A doctor's failure to identify an injury or a disease can constitute a departure from standard of care.  If a patient-doctor relationship has been established, and the doctor should have been able to appropriately diagnose an injury or disease, that doctor may be held liable for the resultant pain, suffering, injury, etc. that could have been prevented had the original injury or disease been detected prior.
